Yes, there is definitely a lot of pure ignorance about the implications of copyright law in fandom. There is also a lot of blind adherence to copyright law. I was a copyright hippie by way of of the open source software movement before I was involved with fandom, and I bring that baggage with me. I think copyright law is broken and I regularly disregard it when I think that is the appropriate moral and/or artistic choice, but I try to disregard copyright law thoughtfully and deliberately (though not consistently. I believe that the moral calculus of reproducing art is complicated and there shouldn't be rules applied senselessly for the sake of having consistent rules)
But the way most fandom works today, in a curious gray area between genuine legal fair use carveouts and an utter disregard for copyright law in all respects, is approximately where I think it should be as a community.
